Service highlights

We advise employers and contractors on the negotiation and drafting of design and build contracts, usually by reference to one of the standard contracts issued by the JCT. We can help you select the most suitable JCT contract for your project, and amend and add to it according to your specific requirements. We also see to preparation of documents to be issued during the course of the project, including collateral warranties, change orders and vesting certificates.
We assist with the preparation of contracts for the appointment of a professional team for your project, including with architects, structural engineers, planning and building control consultants, cost consultants, principal designers, employer’s agent and others. We ensure each carefully reflects your requirements in areas such as insurance, intellectual property rights, assignability, compliance with project documents, and third party rights or provision of collateral warranties for funders, tenants or purchasers of the project.
We represent both borrowers and lenders in secured and unsecured project finance arrangements. We are frequently called upon to advise on, draft and negotiate facility agreements, intercreditor deeds of priority and subordination, as well as related security arrangements, including personal guarantees, debentures, legal charges and mortgages. If applicable, we also arrange for appropriate collateral warranties to be supplied by the principal contractor and any sub-contractors, if required by the lender.
We provide strategic and practical advice to resolve any disputes that arise in the delivery of a construction project, whether caused by delays, non-payment, breach of contract, the standard of work or otherwise. We advise on any dispute process that needs to be followed under the underlying contractual documents, and on the merits of mediation and arbitration at an early stage to avoid the escalating costs of litigation.
We provide cost effective legal support for the sale of units at the completed project through preparation of standard leases and contract packs, providing prospective purchasers with all of the title and other information needed as part of the standard conveyancing process.
